American Tradition Institute Colorado Lawsuit, Part 1 - Pollution Issues


On April 4, 2011, American Tradition Institute, American Tradition Partnership and plaintiff Rod Lueck sued the State of Colorado and several officials over the constitutionality of the state's Renewable Energy Standard mandate. The RES requires the state's major utilities (mainly Xcel Energy) to obtain 30 percent of their power generation from "renewable" sources by the year 2020. ATI claims that the Colorado RES discriminates on its face against legal, safer, less costly, less polluting and more reliable in-state and out-of-state generators of electricity sold in interstate commerce. This discrimination is forbidden by the Commerce Clause, which reserves the regulation of interstate commerce to the federal government. Obama Care is being argued in federal court on its constitutionality, on whether or not congress has the constitutional authority to compel people to buy a product sold by a certain industry. Of course they do not, but that will be up to the court to decide. Why will it be up to them? Because in this country we live by a thing called 'the rule of law", and the day that we do not is the day that we are no better than banana republic. OK, you got me on that one, because we have already not lived up to the rule of law, for example, when Bush bailed out the auto industry without congressional approval, illegally using the TARP (bank bailout money) to do it. But the difference, in my defense, is that it was not challenged. Without a challenge to an illegal act, it is in a way not illegal, as was the case involving the Tyrant's of Bush and Obama bailing out the auto industry. I could go on about the illegal auto industry bailout, about how Obama, by the nod of his head, deprived the secured bond holders of the auto companies what was legally theirs, and then gave it to the auto unions, but that is in another video I made at the time, so I will get back to the "crime" at hand. Pelosi's Misleading Statement on the Constitutionality of Government Health Care


www.tenthamendmentcenter.com by Rob Natelson Speaker Nancy Pelosi has issued a press release in which she purports to rebut those of us who have expressed doubts about the constitutionality of some health care reform plans. Pelosi (or her ghostwriter) claims The 10th amendment to the US Constitution states that the powers not delegated to the federal government by the Constitution, nor prohibited by it to the states, are reserved to the states or to the people. But the Constitution gives Congress broad power to regulate activities that have an effect on interstate commerce. Congress has used this authority to regulate many aspects of American life, from labor relations to education to health care to agricultural production. Since virtually every aspect of the heath care system has an effect on interstate commerce, the power of Congress to regulate health care is essentially unlimited. (bolded in original). For several reasons, this is a highly misleading statement. First, it fails to mention a concern expressed by many constitutional scholars, including those on the Left: Substantive due process. Substantive due process is the doctrine by which the Supreme Court strikes down laws it deems unacceptably interfere with personal privacy or autonomy. Health care laws that, for example, limit ones ability to fund and control ones own health care could well run afoul of substantive due process rules.
