Obama's DOJ Cracks Down on Medical Marijuana: California vs. The Feds


The federal government is in the midst of a crackdown on medical marijuana dispensaries across the state of California. This is despite repeated claims from President Obama and his Department of Justice that they would not devote federal resources to circumventing state medical marijuana laws. "The law has been hijacked by profiteers who are motivated not by compassion, but by money," said Melinda Haag, one of California's US Attorneys, at a DOJ press conference on October 11, 2011. Aaron Sandusky, owner of G3 Holistic, a group of medical marijuana dispensaries in California's Inland Empire, is one such target of the DOJ's crackdown on medical marijuana "profiteers." The DOJ sent him a letter promising to shut down his operations within 14 days. And they followed through. Reason.tv talked to Sandusky, who's long battled the city of Upland's sordid handling of medical marijuana dispensaries, before and after he was raided. "We all want the same thing," said Sandusky. "We want to see less crime. That's why we have these places." Sgt. Glenn Walsh and Agent Mark Brewster, both members of the California Narcotic Officer's Association, believe that the stepped up enforcement from the DOJ is a positive development. "There's no avenue in the law, whatsoever, to accommodate the sales of marijuana," Brewster said. "The government is forcing a form of censorship on us," says Adam Eidinger, co-owner of Capitol Hemp, a two-store chain in Washington, DC that is closing its doors for good on August 1, 2012. "They are saying you can't talk about certain subjects if you're going to sell pipes." Capitol Hemp sells clothing and soaps and a vast array of glass and other types of pipes. Police raided Capitol Hemp last fall after an undercover cop reported "unnatural and deceptive" behavior at the company's Adams Morgan branch. What raised the cop's suspicions? According to the police report, employees corrected his use of the word bong and changed the subject whenever he brought up marijuana. The store's book selection, which included titles on drug legalization, was also cited as proof that the place was really a criminal enterprise. Under current law, drug paraphernalia is illegal, even absent traces of verboten substances. But since anything - from rolling papers to apple cores to beer cans - can be used to smoke pot, federal prosecutors end up relying on "context" to determine when a pipe is just a lawful pipe and not a contraband bong. This first was the Federal alcohol prohibition from 1920-1933. The second is the current war on drugs, which began in 1971. Usually the police leave them alone, and yet other times they act like a military force engaged in urban combat. This February, cops stormed a Columbia, Mo. home, killed the family dog and terrorized a 7-year-old boy -- for what? A tiny quantity of marijuana. Two years ago, in Prince George's County, Md., cops raided Cheye Calvo's home -- all because a box of marijuana was randomly shipped to his wife as part of a smuggling operation. Only later did the police learn that Calvo was innocent -- and the mayor of that town. "When this first happened, I assumed it was just a terrible, terrible mistake," Calvo said. "But the more I looked into it, the more I realized (it was) business as usual that brought the police through our front door. This is just what they do. We just don't hear about it. The only reason people heard about my story is that I happened to be a clean-cut white mayor." Radley Balko of Reason magazine says more than a hundred police SWAT raids are conducted every day. Mernagh (Ontario Superior Court) On April 12, 2011, Justice Donald Taliano found that Canada's Marijuana Medical Access Regulations (MMAR) and "the prohibitions against the possession and production of cannabis (marijuana) contained in sections 4 and 7 respectively of the Controlled Drugs and Substances Act" are "constitutionally invalid and of no force and effect".[19] The government was given 90 days (until July 11) to fill the void in those sections, or the possession and cultivation of Marijuana would become legal in all of Canada. This includes the non-medical use of the drug.[20] The mid-July deadline was extended when federal government lawyers argued that current cannabis laws and regulations should stay in place until Ontario's highest court could hear the appeal which has been scheduled for March 5 and 6, 2012. In granting the deadline extension, the Court of Appeal noted that "The practical effect of the decision if the suspension were permitted to expire on July 14 would be to legalize marijuana production in Ontario, if not across Canada."
