YouTube is acting as a vigilante when it claims, dishonestly, that some entity has made a copyright claim on your video. If YouTube is the copyright holder, then they should make that absolutely clear to users as, frankly, it is a clear conflict of interest to defend non-users copyrights and to treat users' rights as if they don't exist. YouTube won't let me recharacterize my own video and reupload it, yet any one else has a free hand to copy and reupload my videos as they wish. I use a public speech by a dead president (JFK's "secret societies" speech) and YouTube claims, before anyone has seen it, that a copyright claim has been entered. That is a lie; YouTube is acting as agent for the copyright holders which is a conflict. YouTube should also not use the most restrictive copyright law in the jurisdictions within which it operates. If a real complaint is made in New York where New York law claims an audio recording has a permanent ban against any kind of re-use, including fair use, then YouTube should block New Yorkers and New Yorkers only. Bad law needs to have consequences. But, until the proper steps required by law have been taken, YouTube has no right to block and punish users. That is vigilante-ism which we Americans object to.
