Elizabeth Warren introduces Andrew Giordano, a retired Baltimore police officer and Vietnam veteran who manages a fitness center for seniors. In 2009, his bank made a mistake that caused confusion about a replacement debit card for one of his accounts and automatically enrolled Andrew in an "overdraft" protection that he never asked for—a practice that has since been prohibited. Andrew was hit with hundreds of dollars in overdraft fees and when he discovered the bank's error and explained the situation, the bank was willing to refund only part of the fees. NEWS: Wells Fargo & Co. to Pay Over $200M for Excessive Overdraft Fees


Wells Fargo & Co. (NYSE:WFC) has been ordered to pay over $200 million back to customers who were alleged to have been charged millions of dollars in faulty overdraft fees, The Wall Street Journal reports Wednesday. Northern California court Judge William Alsup ruled that the bank attempted to generate additional fees for customers using excessive overdraft fees. Wells Fargo officials told Reuters that the ruling "disappointed" the bank, and that they plan on appealing. The banking industry reportedly generates $40 billion per year by charging overdraft fees. SmarTrend currently has Wells Fargo in anUptrend and is currently monitoring these developments to alert subscribers to any change of trend. Wells Fargo should find initial resistance at its 50-day moving average (MA) of $27.36 and further resistance at its 200-day MA of $28.65. In the last five trading sessions, the 50-day MA has fallen 0.31% while the 200-day MA has slid 0.18%. Shares of the bank are trading down 3.75% Wednesday afternoon at $26.73.

Overdraft fees are truly small, high-cost loans made by banks or credit unions to an account holder who is "in the red," often without the account holder's consent. The bank recoups the loan amount, plus a fee averaging $34 from the account holder's next deposit. Often marketed inappropriately as "bounce protection," the abusive fee-based overdraft loan should not be confused with cheaper sources of back-up funds for checking accounts. These loans can make a small purchase, even a sandwich or doughnut, cost the unsuspecting bank customer over $30, and they can trigger a domino effect of debits that leaves the customer struggling to climb out of a negative balance. Granted, I wasn't making much money when this happened, not that I'm loaded now, but I was able to get the Arbitration fee of $700+ waved... I received a notice of a class action settlement. .. from counsel for us as a class group ..the attorney is ben barnow in chicago ..for the case entitled Schulte et.al v Fifth Third bank (cs no1:09-cv-06655) ...I went back and looked at some activity from 2007 when I was traveling across the USA ...and was juggling the use of credit & debit cards ...5th/3rd hit me with some hefty fees during that period, sometimes repeatedly ..and apparently in a self-serving manner to make more money off me in fees.. they reversed a few, but not all & I still ended up paying $100 in fees..despite trying to explain to them that I was traveling at the moment & could not make a deposit... plus by that time I was returning west where 5th/third has no banks or atm machines..they could have been more accomodating given my situation, but I ended up hit with at least $100 in fees...outrageous to say the least .. and here's another thing.. not related to the class action matter or overdraft, but I stopped using the account after 2008 ...even though I left it open with a small balance.. figuring I would use it again when I returned to the midwest (which I do periodically)..so just this month (jan 2011) I called to check my balance & I found out they had closed my account because of <b>...</b>
