Yahoo Sues Facebook Over Patents


Has Facebook ever not been fighting a major lawsuit? Yahoo is suing the world's biggest social media giant, alleging Facebook stole a total of 10 patents owned by Yahoo, including its advertising model, newstream, and messaging features. Facebook called the 19-page lawsuit puzzling, especially because Yahoo is one of its business partners, and plans to fight the suit. Media insiders are equally mystified, wondering if Yahoo is trolling for money. Some wonder if the aggressive tactics against Facebook are stemming from new CEO Scott Thompson. But the move, and it's timing, isn't without precedent. Yahoo retained the same law offices to sue Google just before that company went public in 2004, and scored Google shares valued at around $200 million. If this doesn't work out, maybe Yahoo and the Winklevoss twins can start a support group for people who sue Facebook and lose.

[Recorded: August 24, 2011] THE MOTION: SOFTWARE PATENTS ENCOURAGE INNOVATION Proponents of software patents argue that software deserves the protection of patents just as any other invention does. Software is simply a description of computer instructions that allow a processor to perform complex tasks. Particularly in today's knowledge economy, the value of software is growing and patents protect the investment of time, effort, and money made by companies and individual programmers. Critics of software patents argue that they stifle innovation rather than promote it by cutting off the free flow of ideas needed to advance technology. Software consists of mathematical equations, which cannot and should not be patentable. Most software patents describe algorithms that are simple or obvious to a programmer of ordinary skill and thus do not deserve patent protection. Google Tech Talks August 6, 2008 ABSTRACT Many patents granted by the US Patent and Trademark Office ("PTO") are undeserved. They are granted for several reasons, including that the PTO is not aware of significant prior art (knowledge already in the public domain), that the PTO's employees are not given sufficient time and resources to do an effective screening of patent applications and that the rules regarding how patents are granted are skewed through perverse patent policy to favor the granting of patents. Undeserved patents injure the public because they can be used by private actors to preclude activity that would otherwise be permissible, if not desirable. This causes prices for goods to be artificially high, the advancement of science to be thwarted, and civil liberties to be inappropriately restrained. The Public Patent Foundation ("PUBPAT") is a not-for-profit legal services organization whose mission is to represent the public interest against the harms caused by errors in the patent system, and particularly the harms caused by undeserved patents and unsound patent policy. PUBPAT provides the general public and specific persons or entities otherwise deprived of access to the system governing patents with representation, advocacy and education. The question was whether a business method is enough of an invention to receive a patent. Patents are a form of intellectual property. They give legal protections to individuals and companies against the copying of their inventions. Bernard Bilski and Rand Warsaw wanted to patent a method to let traders protect against the risk of price changes in energy markets. The United States Patent and Trademark Office said no. So the inventors went to court. Again they were told no. Finally, the case went all the way to the Supreme Court. In June, all nine justices said no. But they only said no to a patent in this case. Patent lawyer Meredith Martin Addy in Chicago explains that the court ruled narrowly.She said: "The Supreme Court held that there is no categorical rule denying patent protection for business method patents."When patent laws were first developed, most patents were for machines. But since the late nineteen nineties, inventors of business methods and processes have increasingly sought patent protection. Apple Patents 'Slide-to-Unlock' Technology


BY BRICE SANDER If you're holding an Android device, you might be helping Google break the law. Apple now owns the patent for slide-to-unlock technology- meaning any device using that feature infringes on Apple's creative rights. (Apple) It took three years to snag the rights, so experts expect Apple to go after patent plagiarizers ASAP. As a ZDNet blogger notes, it's just the way the system works. "I hate that design elements can be patented, instead of actual devices which makes more sense. Apple has been riding the patentability of design elements for a while, and has a number of Android device makers on the ropes as a result." Apple's patent wars have become the stuff of legend--says a TIME blogger-- especially the company's ongoing fued with Samsung. "Samsung's Galaxy Tab has been pulled off of the shelves in some countries, while in others its launch has been delayed. It was also rumored that Samsung's flagship Galaxy Nexus was purposely built to avoid patent infringement..." So could this affect the new Android operating system? Droid Matters says it depends on how Apple views Droid's new facial recognition unlock system. "Google should definitely look into this, or maybe they already are. Because we don't expect Apple, the patent 'vampires' they are, to sit still without filing another lawsuit." But the BBC quotes a techie who suggests there may be a loophole for Google and other Apple targets. "'...when [patents] are challenged there is a counter action to claim <b>...</b>
